1. General Rental Agreement

 * Binding Contract: All bookings are subject to our comprehensive, signed Rental Agreement Contract, which incorporates these Terms. In the event of a conflict between these Terms and the signed Contract, the terms of the signed Contract shall prevail.

 * Estate/Vintage Disclaimer: The Client acknowledges that all Vintage and Preloved Vessels are unique and may exhibit natural signs of age, wear, patina, and minor imperfections, which are considered part of their character and are not grounds for a refund or damage claim.

2. Intellectual Property and Usage Rights

 * Ownership: All Rental Items, including the antique Vessels and the design of the Estate Faux Floral Arrangements, remain the exclusive property of Heirloom Plume and Petal.

 * Photography/IP: Any photographs, designs, or mock-ups created by Heirloom Plume and Petal for the Client or displayed on this website are the intellectual property of Heirloom Plume and Petal. We reserve the right to use photographs of our Rental Items in marketing materials, social media, and on our website.

 * Client Images: The Client grants Heirloom Plume and Petal a non-exclusive, perpetual, royalty-free license to use any photographs of the Rental Items taken at the Client’s event for promotional and marketing purposes, provided appropriate photo credit is given where possible.

3. Website Use and Information Accuracy

 * Accuracy of Information: While we strive to ensure all information, descriptions, and pricing on our website are accurate, errors may occur. We reserve the right to correct any errors and to change or update information at any time without prior notice.

 * Availability: Display of a Rental Item on the website does not guarantee availability. All bookings are confirmed only upon receipt of the non-refundable Booking Fee and the signing of the Rental Agreement Contract.

 * Links to Third Parties: Our website may contain links to third-party websites (e.g., event venues, planners). Heirloom Plume and Petal is not responsible for the content, security, or privacy practices of these external sites.

4. Privacy and Data Protection

 * Data Collection: Heirloom Plume and Petal collects personal data (name, address, email, payment information) only for the purpose of processing your rental order, delivery, and communication.

 * Data Usage: Your data will not be sold or shared with third parties for marketing purposes. We handle all data in accordance with the UK's General Data Protection Regulation (GDPR) standards.

5. Limitation of Liability

 * Exclusion: Heirloom Plume and Petal shall not be liable for any indirect, special, incidental, or consequential damages (including lost profits) arising from the rental or use of the Rental Items.

 * Maximum Liability: In all circumstances, the maximum liability of Heirloom Plume and Petal to the Client for any claim, loss, or damage arising under this agreement is strictly limited to the total rental fee paid by the Client for the specific Rental Item that is the subject of the claim.
